These Terms of Service ("Terms") govern your access to and use of the Factum Labs truth-verification service, including our website at factumlabs.net, email verification service (check@factumlabs.net), and WhatsApp integration (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. Description of the Service
Factum Labs provides an AI-assisted fact-checking service. You may submit content (claims, headlines, messages, links, or images) and receive a verdict indicating whether the content appears to be true, false, misleading, or AI-generated, together with supporting sources and reasoning. Verdicts are generated by automated systems and are provided for informational purposes only.
3. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Submit content that contains illegal material, including content that violates copyright, defamation, obscenity, or privacy laws.
- Use the Service to harass, threaten, or harm any individual or group.
- Submit personal information about third parties without their consent.
- Attempt to reverse-engineer, scrape, or otherwise extract the underlying models or data from the Service.
- Use automated tools to submit high volumes of requests in a manner that disrupts the Service.
- Misrepresent our verdicts or present them as official legal or medical advice.
- Use the Service in connection with spam, phishing, or other deceptive activities.
4. No Professional Advice
The verdicts and information provided by the Service are for general informational purposes only and do not constitute legal, medical, financial, journalistic, or any other form of professional advice. Factum Labs verdicts are AI-generated and may contain errors. Do not make important decisions based solely on our output. Always consult qualified professionals for matters of significance.
5. Accuracy Disclaimer
While we strive for accuracy, Factum Labs does not guarantee that any verdict is correct, complete, or up to date. AI systems can and do make mistakes. Our verdicts reflect the best assessment of our automated systems at the time of processing, based on available sources. We are not liable for any loss or damage arising from reliance on our verdicts.
6. Intellectual Property
All content on factumlabs.net — including text, graphics, logos, and software — is the property of Factum Labs and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
By submitting content to the Service, you grant Factum Labs a limited, non-exclusive, royalty-free licence to process that content for the sole purpose of providing you with a verdict. You retain ownership of your submitted content.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Third-Party Services
The Service uses third-party providers (including AI inference and search providers) to deliver verdicts. We are not responsible for the actions, data practices, or availability of those providers. Use of the Service is subject to those providers' terms where applicable.
9. Service Availability
We provide the Service on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time without notice. During the current beta test period, the Service may be unstable, inaccurate, or unavailable at any time.
10. Limitation of Liability
The Service is in beta test mode. To the maximum extent permitted by applicable law, Factum Labs provides the Service with absolutely no warranties, express or implied. Your use of the Service during the beta period is entirely at your own risk.
To the fullest extent permitted by applicable law, Factum Labs and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed CHF 10 (ten Swiss Francs).
11. Indemnification
You agree to indemnify, defend, and hold harmless Factum Labs and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.
13. Governing Law and Disputes
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Switzerland. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Changes to These Terms
We may revise these Terms at any time. We will indicate the revision date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
